Trial Departments

The trial judge is responsible for hearing motions in limine, motions for new trial or to set aside and vacate a judgment pursuant to Code of Civil Procedure section 663, motions to stay judgments, motions to tax costs after trial, and proceedings to settle any statement on appeal. Motions heard by the trial judge are filed directly in the appropriate department, and fees are paid at the Civil Front Counter.

*Hearing dates for Motion’s to Compel (Name Extension), Motion’s to Compel Further Discovery Responses, and Motion’s to Compel Discovery (not “Further Discovery”), Demurrers and Motion for Judgment on the Pleadings in all cases where the complaint alleges one or more claims pursuant to the Song-Beverly Consumer Warranty Act (Civ §1790 et seq.) must be made by calling the clerk at (916) 874-7858 or (916) 874-7848 before submitting moving documents to the court. Phone hours are Monday through Friday, 8:30 a.m. to 4:00 p.m. (closed from 12:00-1:00). Reservations made through the Court Reservation System (CRS) may be canceled without notice.

Any motion submitted without a reserved hearing date will be subject to rejection.

Refer to the Writ Department webpage for additional requirements for reserving hearings. Tentative Ruling issued at 2:00 p.m. on the court day before the hearing and available on the Public Portal. Requests for oral argument must be made by 4:00 p.m. on the court day before the hearing.	Applications for ex parte relief and oppositions thereto should be filed directly in the assigned department. When documents are not filed directly in the assigned department, parties shall deliver an endorsed copy directly to the department. Parties wishing to request an ex parte hearing must contact the clerk in the assigned department. 10A	George Acero	Minor’s Compromise	Parties shall submit petitions and proposed orders with “TBD” indicated as the date and time for the hearing, as all filings are being reviewed on the papers. Upon review of the submitted Minor’s Compromise filings, if it is determined that a hearing is necessary, parties will be notified of the date and time of the hearing and will be provided the instructions for how to appear remotely.	Filings shall be submitted by mail to 500 G Street, Attn: Civil Division, placed in the Civil Drop Box on the 2nd floor of 500 G Street, or e-filed. Requests for withdrawal of minors' funds are heard in the Probate Division and will be allowed only upon filing a verified petition, unless the order compromising the claim specifically provides that the funds may be withdrawn once a minor reaches 18 years of age. The petition shall be on the adopted Judicial Council form.
11B	Thadd Blizzard	Orders of Examination	Friday between 9:00 a.m. and 12:00 p.m. All hearings must be reserved with the department clerk prior to any filings being submitted to the court. The Proof of Service must be filed in the department on the day of the hearing pursuant to Local Rule 2.10. On the date of the scheduled hearing, all parties must check in with the clerk of the department. The Judgment Debtor will be given an oath, and the examination will proceed privately between the parties. When the examination is concluded, the parties will be released, and no further appearance will be required.	An Order of Examination can be continued pursuant to stipulation at the hearing or prior to the hearing, upon written stipulation for continuance with the appropriate filing fee.

The Settlement Conference may be dropped from the court’s calendar for failure to submit a Settlement Conference Statement as required. The Settlement Conference Statement is to be emailed to the Settlement Conference Center as a PDF attachment. The Settlement Conference Statement does not become a part of the permanent record. The document will be received, but not filed. Settlement Conference Statements should not be e-filed.
